Terms of Use Agreement

This Terms of Use Agreement provides the terms and conditions governing the use of Website. You agree to use Website in a manner consistent with all applicable laws and regulations and in accordance with the terms and conditions discussed below, as well as those listed throughout this Website.

This agreement is between Website, and all users. Unless the context requires otherwise, the Website, and/or their assigns shall be referred to as "Website, us, we, or our" and you shall be referred to as "you, your or subscriber."

Terms of Use for PI ONLINE Trainings and PI OFFICE

PI Coaching Private Client Contract

This is a contractual agreement between Personal Injury Training LLC (PIT) and YOU (hereafter referred to as client). The purpose of this agreement is to outline the mutual obligations between client and PITI.

Recitals

Whereas PITI has developed insight and knowledge of personal injury (PI) practice procedures and management through experience and training, 

Whereas client wishes to utilize said procedures so as to increase the productivity and profitability of his or her own PI practice.

PITIwill offer the best materials, ideas, procedures and knowledge; no legal advice is offered or provided. The outcome of any particular procedure or case is dependant on parameters outside the control of Personal Injury Training Institute. There is no guarantee on outcome or results whatsoever.

Now, therefore, the parties agree as follows:

Consideration

Client shall pay to PITI: One thousand ($1,000) in advance then ($600) per month in a minimum of 5  consecutive monthly installments, due on the first (1st) day of each month. The contract automatically continues month to month at six hundred ($600) per month. Client or PITIis required to provide written cancellation 30-days in advance after the initial 6-months if terminating this agreement. A 10% monthly service charge will be added to accounts that are more than five (5) days overdue.

Client may e-mail questions and concerns to PITIat anytime. We will address this information during the phone consultation times. It is the client’s responsibility to call at the scheduled time (MT) for phone consultations. There may be exceptions and adjusted times based upon trials, speaking engagements and other commitments or circumstances beyond the control of PITI. This time may also be used to train staff and solve PI problems. 

Nonrefundable

The consideration paid by client is nonrefundable whether or not client utilizes his/her opportunity to learn and apply the principles of the PITI Program. If either party shall institute suit to enforce any covenant of this agreement, the prevailing party shall be entitled to interest, court costs and a reasonable attorney’s fee. The court will fix the amount of reasonable attorney’s fee.

Copyright

None of the materials associated with PITI may be reproduced or quoted in whole or in part by copy or any other printed means or for presentations for any reason without written permission from: PITI, Dr. Jeffrey A. States (with the exception of PI OFFICE for the sole use of the client).

Acknowledgment of receipt

Client acknowledges that prior to the signing of this contract he/she read and received a legible, exact, and completely filled-in copy of this contract and that upon signing such copy, which is also signed by PITI, he/she received a copy of every other documents he/she signed during the contract negotiations and agrees to the terms.

PI OFFICE & PI ONLINE TRAINING LICENSE AGREEMENT

You are agreeing to the terms of this Agreement for PI OFFICE and PI ONLINE Trainings. Use of the PI Office & PI ONLINE Training are subject to this agreement. If you do not agree to the terms of this Agreement, notice Personal Injury Training, within 48 hours of purchase.

Personal Injury Training grants you a non-exclusive right to use this copy of PI Office and accompanying materials according to the following:

You May

a)    use and install PI Office on only one computer at a time;

b)    make one (1) copy of PI Office for backup purposes; 

c)    transfer PI Office from one computer to another so long as PI Office is neither used on nor copied onto more than one computer at a time (except for the same users business and home computer); and

d)    modify forms and add your own letterhead.

 

You May Not

a)    modify, reverse engineer, or copy (except for the backup copy of PI Office or accompanying materials); or

b)    rent or transfer PI Office.

This license is not a sale. Title and Copyrights to PI Office and accompanying materials remains with Personal Injury Training LLC and its licensors. Any breach terminates this Agreement.

LIMITED WARRANTY, DISCLAIMER, AND LIMIT OF LIABILITY

If at any time PI Office fails to operate as described in the documentation, contact to Personal Injury Training LLC of your concerns.  Personal Injury Training will communicate conflicts or resolve the issue. Personal Injury Training and its licensors do not warrant your data, that PI Office will meet your requirements, or that the operation will be uninterrupted or error free.

THE WARRANTY ABOVE IS IN LIEU OF ALL OTHERS, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANT ABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SOME STATES HAVE LAWS THAT MAY RESTRICT OR PROHIBIT THE LITIGATIONS SET FORTH ABOVE AND YOUR RIGHTS UNDER LAW MAY VARY ACCORDING TO THE LAWS OF YOUR STATE.

Personal Injury Training and its licensors shall not be liable for any incidental or consequential damages, including loss of data, lost profits, cost of cover, or other special or indirect damages. Your rights under law may vary.

US GOVERNMENT RESTRICTED RIGHTS

PI Office, PI ONLINE Training and documents are provided with Restricted Rights. Use, duplication, or disclosure to the Government is subject to restrictions, as set forth in subparagraph Ó(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs Ó(1) and (2) of the Commercial Computer Software – Restricted Rights at 48 CFR 52.227-19, as applicable. This license agreement and limited warranty will be governed by the laws of the state of Utah. If any provision is found void or unenforceable, the remainder of the agreement shall remain valid and enforceable.
